Terms of Service
Last updated: 26-10-2026
These Terms of Service ("Terms") are an agreement between you and Big Market 360 Private Limited ("Awtiz", "we", "us"), a company registered in India with its registered office at F211, First Floor, Express Zone Commercial Hub, Goregaon East, Mumbai 400063, Maharashtra, India. They apply when you use awtiz.com or any of our services. If you accept these Terms for a business, you confirm that you are authorised to bind that business, and "you" means the business.
A signed order form or proposal may add to these Terms. If it conflicts with these Terms, the order form wins for that order.
1. Our services
- WhatsApp Business API service: we connect your business to Meta's WhatsApp Business Platform (Cloud API) through Meta's Embedded Signup, and provide software and support to send and receive WhatsApp messages, manage templates, broadcasts, inboxes, automations and integrations.
- AI Bots service: we design, build, host and maintain AI assistants trained on content you provide, for use on your website, apps or internal tools.
The features, limits and fees for your plan are set out in your order form or on our pricing page.
2. Your account
- Give us accurate information and keep it up to date.
- Keep your login details safe and tell us at once about any unauthorised use. You are responsible for what happens under your account.
- Only people you authorise may use your account.
3. WhatsApp and Meta rules
To use the WhatsApp Business API service you must also accept, and keep to:
- the WhatsApp Business Solution Terms,
- the WhatsApp Business Messaging Policy and Commerce Policy, and
- Meta's terms and policies that apply to your Meta Business account.
In particular, you must:
- message only people who have opted in to receive messages from you, and stop when they ask;
- not send spam, use bought or scraped contact lists, or promote prohibited goods or services;
- keep your business verified and your display name and profile accurate.
The WhatsApp Business Account and phone number belong to you. Meta may review, limit, suspend or close your WhatsApp account, number or templates under its own policies, and may change its platform, prices or features. We will help you resolve such issues, but we are not responsible for Meta's decisions or for interruptions caused by Meta.
4. Acceptable use
You must not use our Services to:
- break any law, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 and TRAI regulations;
- send content that is unlawful, fraudulent, defamatory, obscene, hateful or infringes anyone's rights;
- collect sensitive data, such as card numbers or passwords, in a way the law or WhatsApp's policies do not allow;
- impersonate anyone, or mislead people about who you are;
- attack, overload, probe or reverse-engineer our systems; or
- resell the Services without our written agreement.
We may suspend Services that put our platform, our other clients or WhatsApp numbers at risk, and will tell you why.
5. AI Bots
- Make sure you have the right to give us the content used to train your bot.
- The bot follows the business rules you set, such as prices, discounts, refunds and timings. You are responsible for those rules.
- Before the bot calls or messages your customers, you must have any consent the law requires, including TRAI rules on calls and messages and WhatsApp's opt-in rules.
- You choose which of your apps the bot connects to and what it may do in them. You must have the right to give that access, and you are responsible for the actions you allow. You can disconnect any app at any time.
- AI can make mistakes. We design bots to answer from your content and to hand over to people, but you should review the bot's answers and must not rely on it for medical, legal, financial or safety-critical decisions without human review.
- Tell the people who use your bot that they are talking to an automated assistant.
6. Fees and payment
- Our fees are in Indian rupees and exclude GST, which is added to every invoice.
- WhatsApp message charges are set by Meta and billed by Meta to the payment method on your WhatsApp Business Account, unless your order form says we will pass them through.
- Subscriptions renew automatically for the same period unless you cancel before the renewal date.
- Invoices are due within 7 days unless your order form says otherwise. We may pause Services if payment is more than 15 days late, after giving you notice.
- Set-up fees and fees for periods already started are not refundable, except where the law requires or we agree in writing.
7. Your data
You own your data, including your contacts, messages, bot content and conversations. You allow us to use it only to provide and support the Services for you. We handle personal data as described in ourPrivacy Policy, acting as your processor for data about your customers. You are responsible for having a lawful basis, such as consent, to send us and message your customers' personal data.
8. Our property
Our software, website, designs and know-how belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use them during your subscription. Feedback you give us may be used to improve the Services.
9. Confidentiality
Each of us will keep the other's non-public business information confidential and use it only to perform this agreement, except where disclosure is required by law.
10. Warranties
We will provide the Services with reasonable skill and care. Apart from that, the Services are provided "as is" and we do not promise that they will be uninterrupted or error-free, or that any particular business result will follow.
11. Limits on liability
To the extent the law allows, neither of us is liable for indirect or consequential losses, or for loss of profit, revenue, goodwill or data. Our total liability for all claims in any 12-month period is limited to the fees you paid us in that period. These limits do not apply to fraud, or to anything that cannot be limited by law.
12. Indemnity
You will compensate us for claims, fines and costs caused by your content, your messages, or your breach of these Terms or of WhatsApp's or Meta's policies.
13. Ending the agreement
- You may cancel your subscription at any time; it ends at the close of the current billing period.
- Either of us may end the agreement at once if the other seriously breaches it and does not fix the breach within 15 days of notice.
- When the agreement ends, we stop the Services, disconnect our app from your WhatsApp Business Account, and let you export your data for 30 days before we delete it, as described in our Privacy Policy.
14. Changes
We may update these Terms. We will post the new version here and tell clients by email at least 15 days before significant changes take effect. If you keep using the Services after that, the new Terms apply.
15. Law and disputes
These Terms are governed by the laws of India. We will first try to resolve any dispute through good-faith discussion. If that fails within 30 days, the courts at Mumbai have exclusive jurisdiction.
